VOTE YES ON HOUSE BILL 101

Next week the House State Affairs Committee will consider H. 101 -- a bill drafted and supported by the Idaho Building Contractors Association. H. 101 would prohibit cities and counties from enacting costly contractor licensing programs and the local level.

It is IBCA's position that there should be one central form of contractor regulation -- the Idaho Contractor Registration Board.  Keeping regulation centrally located with the state of Idaho will encourage uniform regulation so builders don't have to guess the rules for multiple jurisdictions.  It will also save the contractor who builds regionally from having to obtain a license in multiple cities.

  STATEMENT OF PURPOSE

 

H. 101

 

      In 2005, the Idaho legislature enacted the "Idaho Contractor Registration Act."  Prior to its enactment, the state of Idaho had no means of regulating incompetent, dishonest, or unprincipled construction contractors.  Because the state had no system of registration, three cities in Idaho created separate and distinct contractor licensing programs (Idaho Falls, Pocatello and Chubbuck).

 

      A significant reason for passing a statewide registration program was to prevent "piece-meal" local contractor licensing programs that would require contractors to purchase licenses in multiple jurisdictions.  A state contractor registration system provides uniformity in contractor requirements and avoids duplicative and costly licensure fees.

 

      During the drafting of the state act, a provision was negotiated to allow the three cities with contractor licensing programs to continue their programs.  The statutory language was too broadly worded.  Multiple other cities have now expressed interest in creating costly local licensing programs.

 

      This legislation will prevent further "piece-meal" licensing of construction contractors.  Further it will "grand father" in the three cities with existing licensing programs.

 

FISCAL NOTE

 

There is no impact to the General Fund.

Please vote yes on House Bill 101! As a building industry representative for a McCall area builder, I can say with certainty that the confusion between county building codes and regulations causes enough confusion. Keep the licensure legislation strong by maintaining the same requirements and costs throughout the state. If this legislation passes, the fracturing of criteria will weaken the reasoning for having licenses.
